from a bad deal they have a lot more power going into 2013 in that, basically president obama is going to have to deal with them on the debt ceiling. why not negotiate from a position strength in 2013? any tax increases now are retroactive, rather than give in and basically do great harm to your brand in the near term in return for nothing? ashley: basically what lesson do we learn, john, if we indeed take your advice and walk away or republicans walk away and just fall off the cliff? >> well the lesson we learn americans will still get up on january seg and go to work because what is they're going to do. the other lesson we'll learn from this is the politicians, whether republicans or democrat live to spend your money. so anytime they're not passing laws in haste, we're much better off. ashley: very good. leave it at that. john tamney, forbes opinion editor. joining us from the place with folks under the might be scope, d.c. john, thank you very much. >> thank you very much. ashley: markets holding their ground up about 57 points. even as time slips away from washington. shibani: trad

down deal from president obama? >> yeah. i believe we need a big deal, but the more likely possibility, at this point, is it's really focused on a tax deal where they come up with some number between what speaker boehner and president obama talked about, that they address things like alternative minimum tax, and put together a deal that we either try to pass before the end of the year or get agreement to come back right after the first of the year and pass it through both houses. adam: the numbers were something like the president at one point was willing to raise his baht -- bottom line to 400,000. if that's the deal, can you guys, can the men and women in our political leadership pass something before midnight, december 31? >> well, i think so. i mean, and you're going exactly the right direction. if you take what's been put on the table, you got the senate bill, you got the house bill, and you got what president obama and speaker boehner talked about, somewhere in the middle, i think, is a deal we could pass before year end, and as you say, it would be in the $400,000 to $500,000 ra

sort of agreement. a potential headache. not on the horizon for president obama because he has a deal with, you know what i am going to say, those two words, he is meeting with congressional leaders at 2:00 p.m. let me bring in senator kay bailey hutchinson. given how both sides of the aisle are acting, senator, are you proud of your fellow lawmakers and how they are handling the nation's business as you get ready to exit? >> well, the best part of what you just said is my exit. [ laughter ] >> it is pretty depressing, honestly, to watch all the posturing. however, you know, i continue to believe that everybody understands that the fiscal cliff would be too huge a burden on american families. therefore, i hope so much that when they meet this afternoon, even though it is a photo off and probably now not progress to be made that minute that they will make in agreement to come up with something that they can at least try to us of the double republicans and democrats can vote for. that is the only way we will be able to pass anything or either house. dagen: what did your fellow republica

as lawmakers continue to scramble to get a fiscal cliff deal done. rich edson has the latest. rich: they are considering legislation here in the senate today. president obama says he called to talk to congressional leaders, democrats and republicans, last evening. there is no progress here to report. president obama put it all on the house. >> they are operating without the house of representatives. it is being operated with a dictatorship of the speaker, not allowing the vast majority to get what they want. if the 250 would be brought up, it would pass overwhelmingly speaking that 250 he is discussing that would keep tax rates where they are for income amount for less than $250,000 increased those earning more. house speaker says senator reed should talk less and legislate more. senate democrats have not. they want to extend all the current tax rates and avoid some of the spending cuts. democrats are on their opening offer. they basically have not moved anywhere. there is less than a week to go. >> senator reid talking about a less than $250,000 limit. speaking right. exactly. liz

. we will see when president obama gets back tomorrow. dennis: small, thinking a smaller deal rather than something sweeping. >> there was a sense the week or two ago that you have a big deal or we go off of the cliff but dynamics change next week and the reality is what is possible here is a small deal probably something that deals with the tax breaks or tax levels for most americans under $250,000 or maybe half a million dollars being extended, great uncertainty about everything else including tax rate for others in spending cuts and decisions kicked into next year seem to be possible and if that is possible the kind of deal i just described is probably only possible through the house with an equal number of democratic and republican votes. that is the most likely scenario right now. dennis: would this be a positive scenario? a small agreement with bipartisan support. is that a victory or is the humiliating and a defeat for both parties? >> good question. the answer is as opposed to what? a victory as opposed to going over the cliff. probably a good thing as you suggest to get some

, yeah, obviously, if people are trying to vote on a deal that includes a tax increase, they should just keep the rates down for people in the rest of the brackets and let obama have his, you know, you do not have to vote for a tax increase. it happens with or without you. you do not have to vote for a tax increase in that way. obama has something to worry about here, by the way. the republicans could even lose the next election because of this. he will have to live with this in the history books. dagen: reelection or legacy? great to speak with you, david. happy new year. tom kloza is coming up next. we had record gas prices this year. the average price we paid this year was a new record. will it be even higher in 2013? the top-selling car in 2012 was the ford focus. kind of little. if you are celebrating, finding that cab ride home after the party is going to cost you some coin. we are talking about limo service. i have used it. it is kind of nice. take a look at the treasury markets. the bond market closes today, early at 2:00 p.m. eastern time. that is what the federal government can
